These Terms and Conditions (“Terms”) govern the use of the Boat Charter Malta website and all bookings, rentals, and charter services provided by Boat Charter Malta (“we,” “our,” or “us”). By making a booking, submitting an enquiry, or using our services, you (“the customer,” “you”) agree to be bound by these Terms.
1. Booking and Contract Formation
A booking is considered confirmed only once:
- Availability has been confirmed by us or our rental partner, and
- Full payment or a required deposit has been received, and
- A confirmation email or written confirmation has been issued.
All bookings are subject to vessel availability, weather conditions, and operational constraints.
2. Payments
- All prices are quoted in the applicable currency and include only what is explicitly stated in the booking confirmation.
- Full payment or a deposit may be required at the time of booking.
- Any outstanding balance must be paid prior to the start of the charter.
- Failure to complete payment may result in cancellation without refund.
3. Cancellation and Refund Policy (Very Important)
a) Customer Cancellations
No refunds are offered under any circumstances for customer-initiated cancellations, including but not limited to:
- Change of plans
- Late arrival or no-show
- Weather preferences or sea conditions
- Illness or personal reasons
- Transportation delays
Customers are strongly advised to obtain appropriate travel or cancellation insurance.
b) Company Cancellations
Refunds are issued only in the event that:
- Boat Charter Malta cancels a confirmed tour or charter, and
- No suitable alternative date, vessel, or service is accepted by the customer.
In such cases, the refund will be limited to the amount paid for the cancelled service only. No additional compensation, expenses, or damages will be covered.
c) Rental Partner Override
Boat Charter Malta works with independent vessel owners and rental partners.
Any rental partner may overrule or supersede our refund policy at their sole discretion, including:
- Granting a refund
- Offering a partial refund
- Offering a rescheduled charter
- Refusing any refund
Their decision shall be final and binding.
4. Weather and Sea Conditions
- Charters operate subject to safe weather and sea conditions.
- Decisions regarding safety, delays, route changes, or cancellation due to weather rest solely with the skipper, captain, or rental partner.
- Adverse weather does not automatically entitle the customer to a refund.
- Alternative dates or services may be offered at discretion but are not guaranteed.
5. Use of the Vessel and Conduct
Customers agree to:
- Follow all instructions given by the skipper or crew
- Comply with maritime laws and safety regulations
- Behave responsibly and respectfully while onboard
We reserve the right to terminate a charter without refund if:
- Safety is compromised
- Instructions are ignored
- Damage is caused to the vessel
- Illegal, abusive, or dangerous behavior occurs
6. Damage and Liability
- Customers may be held financially responsible for damage caused by negligence, misuse, or failure to follow instructions.
- A security deposit may be required for certain rentals.
- Boat Charter Malta is not responsible for loss, theft, or damage to personal belongings brought onboard.
7. Third-Party Operators and Rental Partners
Boat Charter Malta may act as an intermediary between the customer and independent vessel owners or operators.
- Each rental partner operates under their own licenses, insurance, and operational rules.
- Boat Charter Malta is not liable for acts, omissions, or decisions made by rental partners.
- Rental partner terms may apply in addition to these Terms.
8. Health and Fitness to Sail
Customers confirm that:
- They are medically fit to participate in boating activities
- They disclose any relevant medical conditions when required
- They accept inherent risks associated with marine activities
Participation is at the customer’s own risk.
9. Changes to Itineraries or Vessels
We reserve the right to:
- Substitute vessels of similar type and value
- Modify itineraries for safety or operational reasons
- Adjust departure times or routes
Such changes do not constitute grounds for a refund.
10. Intellectual Property
All content on this website, including text, images, logos, and branding, remains the property of Boat Charter Malta and may not be used without prior written consent.
11. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts.
12. Acceptance of Terms
By completing a booking or using our website, you confirm that you have read, understood, and accepted these Terms and Conditions in full.
